Broff’s Diamond and Loan is a trade name of BDL Acquisitions LLC (“Broff’s,” “we,” “us,” or “our”). We buy, sell, and make secured loans against diamonds, fine jewelry, gold, silver, coins, and gemstones. This policy explains what personal information we collect through our website, how we use it, and the rights you have over it under applicable U.S. law.

This is not an e-commerce site. Visitors typically submit photos of items along with contact details so we can evaluate what they’d like to sell, pawn, or borrow against, and follow up with them directly.

Information You Submit to Request a Quote or Loan

When you contact us through the website, including by submitting photos of jewelry or other valuables, filling out a form, or emailing us, we collect:

  • Your name, phone number, email address, and any other contact details you provide
  • Images and descriptions of the item(s) you submit
  • Any other information you choose to include in your message

We use this information solely to evaluate your item, respond to your inquiry, and provide the loan, purchase, or sale service you requested. We do not sell this information to third parties.

Image metadata: Photos you upload may contain embedded location data (EXIF GPS). We recommend removing this data before submitting images if you do not want location information included. Anyone with access to an uploaded image file can potentially extract this data.

Comments

When visitors leave comments on the site, we collect the data shown in the comment form, plus the visitor’s IP address and browser user agent string, to help with spam detection.

An anonymized string created from your email address (a “hash”) may be shared with the Gravatar service to check whether you use it. Gravatar’s privacy policy is available at https://automattic.com/privacy/. After your comment is approved, your profile picture is visible publicly alongside your comment.

Cookies

  • If you leave a comment, you may opt in to having your name, email, and website saved in a cookie for convenience on future comments. These cookies last one year.
  • Our login page sets a temporary cookie to check whether your browser accepts cookies. It contains no personal data and is discarded when you close your browser.
  • When you log in, we set cookies to save your login and display preferences. Login cookies last two days (two weeks if you select “Remember Me”); screen-option cookies last one year. Logging out removes your login cookies.
  • Editing or publishing an article sets an additional cookie containing only the post ID, with no personal data. It expires after one day.

Analytics and Advertising

We use the following third-party services to understand site traffic and market our services:

  • Google Analytics to understand how visitors use our site. Google Analytics uses cookies and similar technologies to collect information such as pages visited, time on site, and general location.   • Google Ads, including remarketing, to show relevant ads to past visitors on other websites. You can manage ad personalization through Google Ads Settings (https://adssettings.google.com).

These providers may set their own cookies and process data under their own privacy policies, linked above. We do not control their practices beyond the settings we configure.

Embedded content from other websites

Pages on this site may include embedded content (e.g., videos, images, articles). Embedded content behaves exactly as if you had visited the other website directly. These third-party sites may collect data about you, use cookies, embed additional tracking, and monitor your interaction with the embedded content, including if you have an account and are logged in there.

Who we Share your data with

  • If you request a password reset, your IP address is included in the reset email.
  • Service providers noted above (Google Analytics, Google Ads, Mailchimp, and our spam-detection service) process data on our behalf as described.
  • We do not share your mobile information with third parties or affiliates for marketing or promotional purposes. Categories of data other than mobile/text-messaging originator opt-in data may be shared with service providers strictly as described in this policy; text messaging originator opt-in data and consent are never shared with any third parties.
  • We do not sell your personal information to third parties.

How long we retain your data

  • Comments and their metadata are retained indefinitely so we can recognize and auto-approve legitimate follow-up comments instead of holding them for moderation.
  • Inquiry, quote-request, loan, and purchase records (including images and contact details submitted to evaluate an item) are retained for as long as needed to provide the service and to meet our recordkeeping obligations under applicable pawnbroking, lending, and state law (see “Pawnbroker and Lending Disclosures” below).
  • If you register an account on our website, you can see, edit, or delete your personal information at any time (except your username). Website administrators can also view and edit that information.

Pawnbroker and Lending Disclosures

Because Broff’s is a licensed pawnbroker and short-term lender, some of the information you submit is also governed by state pawnbroking law rather than general website privacy law. These state requirements take priority over any conflicting general statement elsewhere in this policy:

  • Identity verification and transaction records. Pennsylvania’s Pawnbrokers License Act (Act 51 of 1937) and related regulations require us to record your name, address, and valid government-issued ID, along with a description of the item and transaction details, for every loan or purchase. We retain these records as long as required by Pennsylvania law and applicable local ordinance.
  • Law enforcement and regulatory reporting. State and local law require pawnbrokers to report certain transaction data to police or state regulators (for example, through a designated electronic reporting system) so that pledged or purchased items can be checked against stolen-property records. This reporting is mandatory and is separate from the marketing-related data sharing described elsewhere in this policy. It is not used for advertising and is not shared with any marketing or advertising partner.
  • Confidentiality of pawn records. Pennsylvania, Ohio (R.C. 4727.18), and West Virginia (W. Va. Code 47-26) each treat pawnbroker transaction and customer records as confidential and not subject to public disclosure, except to law enforcement, regulators, or as otherwise required by law. We do not disclose your transaction records to any other third party.
  • Out-of-state clients (Ohio and West Virginia). If you request a loan from Pennsylvania as an Ohio or West Virginia resident, your transaction is governed by Pennsylvania recordkeeping and confidentiality law as the state where the loan is made. West Virginia law separately requires pawnbrokers to retain transaction records for at least three years; where a stricter retention period applies under your home state’s law, we retain records for the longer of the two periods.
  • Financial information (GLBA). Our loan function involves extending credit secured by personal property, which may qualify us as a “financial institution” for purposes of the Gramm-Leach-Bliley Act (GLBA). Consistent with GLBA’s Privacy and Safeguards Rules, we do not disclose your nonpublic personal financial information to nonaffiliated third parties for marketing purposes, and we maintain administrative, technical, and physical safeguards to protect it.

What rights you have over your data

Depending on your state of residence, you may have rights under laws such as the California Consumer Privacy Act (CCPA/CPRA) and similar state privacy laws. Where applicable, you may have the right to:

  • Know / access – request a copy of the personal information we hold about you
  • Delete – request that we erase personal information we hold about you, subject to our administrative, legal, security, and recordkeeping obligations (for example, transaction records required by pawnbroking or lending law)
  • Correct – request correction of inaccurate personal information
  • Opt out – opt out of the sale or sharing of personal information (we do not sell personal information) and opt out of targeted advertising
  • Non-discrimination – not receive discriminatory treatment for exercising these rights

Text Messaging (SMS)

We offer two separate types of SMS communication. Each requires its own consent, and you may opt out of either one independently.

1. Transactional messages (tied to a specific inquiry or loan). Our website’s “Get a Loan” and “Sell Your Item” forms require a phone number to submit your inquiry. By entering your phone number and submitting one of these forms, you consent to receive SMS messages about that specific inquiry, including: item evaluation and appraisal status, loan approval and loan account status, payment and redemption due-date reminders, and appointment confirmations or reminders. This disclaimer also appears directly beneath the phone number field on the form itself.

2. Marketing messages (optional). Separately, you may check an unchecked-by-default box to opt in to promotional offers and updates from Broff’s by SMS. This is optional, is not required to submit any form or receive service, and is not bundled with the transactional consent above.

For both types: message frequency may vary based on your activity with us. Message and data rates may apply. Text messaging originator opt-in data and consent are never shared with third parties or affiliates for any purpose, including marketing (see “Who We Share Your Data With” above). You may reply STOP at any time to opt out of transactional or marketing messages, and reply HELP for assistance, or contact us directly using the information below.

Loan-related content notice. Because Broff’s is a licensed lender, some transactional texts will include loan account information specific to your transaction (for example, your loan status or an upcoming payment or redemption deadline).

Children's Privacy

Our services are intended for adults conducting lending, buying, or selling transactions. We do not knowingly collect personal information from children under 13, consistent with the Children’s Online Privacy Protection Act (COPPA). If we learn we have inadvertently collected such information, we will delete it.

Do Not Track

Some browsers offer a “Do Not Track” signal. Because there is no common industry standard for responding to these signals, our site does not currently alter its data collection in response to them.

Data Security

We use reasonable administrative, technical, and physical safeguards to protect the personal information you provide. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Changes to This Policy

We may update this policy from time to time to reflect changes in our practices or legal requirements. The “Last updated” date at the top reflects the most recent revision.
